This works simply by dbs issuing a Protective Warrant where the goods are then impounded under the Walking Possession agreement and the tenant is subsequently administered a payment-plan by dbs.

Should the tenant maintain the agreed payment plan without default, dbs will refund all Walking Possession fees to the tenant.

30 day Protective Distraint – total fees refunded £24.00 +VAT
60 day Protective Distraint – total fees refunded £48.00 +VAT
90 day Protective Distraint – total fees refunded £78.00 +VAT

Why a Protective Distraint?

  • A Protective Distraint prevents any other creditor taking an enforcement action against the assets – this protects not only the landlord, but also the tenant
  • The Walking Possession Fees will be refunded upon and only upon the tenant not defaulting on the agreed payment-plan, at the end of the payment term
  • Protective Distraints are not captured on credit history

What is a Protective Distraint?

  • By initiating a Protective Distraint – you are imposing a legal impounding of the tenant’s assets on the demise premises under the form of a Walking Possession agreement
  • The daily charge payable by the tenant for the Protective Distraint is 80 pence per day, plus vat.  The tenant is also liable for the statutory levy and Officer’s attendance charges in accordance with the statutory regulations as set under the Law of Distress and Distress for Rent Rules.
  • dbs will work with the tenant to agree an interest free repayment-plan which the company would administrate on behalf of its instructing client
  • The action of Distraint will prevent any other creditor from enforcing a debt and seizing the assets
  • The purpose of the Protective Warrant action is to work with tenants during their financially difficult periods
  • The tenant is able to trade on the understanding that the assets subject to the Protective Distraint are maintained.
